Health systems gain protected review sharing

Beginning August 1, 2026, Louisiana expands privacy and legal protections for covered healthcare peer review committees. Protected records include reports, drafts, emails, and work prepared for committees, wherever stored. These records are generally protected from court discovery and subpoenas and are limited to proper committee use. Physicians, dentists, psychologists, and podiatrists retain limited access to records supporting decisions against their hospital staff privileges. Otherwise accessible original documents do not become confidential just because a committee holds the only copy. Health systems include two or more commonly owned or controlled hospitals, plus parent companies and affiliated healthcare groups. Systems conducting regular credential or quality reviews can share records within the same system to check provider qualifications, care quality, competence, conduct, or patient safety. Authorized sharing preserves legal protections and cannot itself support damages claims or requests for court orders. Health systems also gain protection from damages for giving covered committees information about patients treated by doctors or dentists, or confined in hospitals or institutions.
