Beginning August 1, 2026, Louisiana sets a formal appeal process for workers’ compensation medical treatment decisions. It covers decisions by the medical director or associate medical director. A party must file a Disputed Claim for Compensation using Louisiana Workforce Commission Form 1008 within 45 days of the decision. The appealing party must notify the medical director within 10 days after filing. The director must send the full decision record to the district hearing office within 15 days after receiving notice. Parties can request that record. Without new evidence, the workers’ compensation judge must uphold or reverse the decision using the original record. With new evidence, the judge must send the case back for the director to reconsider and decide within 30 days. If the director takes no action within 30 days of that order, the judge decides using the entire record. Overturning a decision requires clear and convincing evidence that it did not follow the workers’ compensation treatment law.
