Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 1 costs, 1 mixed.

Subdivision restrictions become enforceable for property owners

Beginning August 1, 2026, parish planning commissions' restrictions listed on subdivision plans before approval and recording carry zoning-rule force. They have the same enforcement methods and penalties, and the same process for changing or removing them. Approved subdivision plans become part of the official plan, but approval does not mean public acceptance of streets or open spaces. Planning commissions can recommend changes to local zoning rules or maps to match their zoning recommendations for approved subdivisions.

Subdivision applicants get deadlines and hearing waivers

Beginning August 1, 2026, Louisiana planning commissions must approve or reject subdivision plans within 60 days after submission. If they do not act, the plan is automatically approved, and the commission must issue a certificate on demand. Applicants can waive the deadline and agree to an extension; commissions must record their reasons for rejection. A hearing is required before action unless an allowed waiver applies. Each plan must name a contact and address for hearing notices. Commissions must send certified-mail notice and publish at least one notice in a newspaper serving the surrounding area. Both notices must be given at least five days before the hearing; mailed notices must state its time and place. Commissions can waive public hearings for subdivisions creating five or fewer lots and no new streets, without a population threshold. Waiver rules must be clearly stated in official subdivision regulations.
