More protections for Louisiana nursing home residents

Beginning August 1, 2026, Louisiana-licensed nursing homes selected for the federal Special Focus Facility Program face added state oversight. Homes must tell current and prospective residents that serious failures to meet state and federal rules caused their program status. Current residents must be offered a safe transfer when an available home meets their location, physical health, and mental health needs. Homes must meet in person with the Louisiana Department of Health within 45 days of selection and agree to fix problems. They must meet state requirements as well as federal program rules. The agreement can require extra monitoring and surprise inspections, correction plans, staff training, approved experts, staffing changes, fines, and other remedies. It can also require analyses of underlying problems and owner performance, or work with a federally approved quality improvement organization. These steps are at the home's expense or as directed by the department. The department must revoke a home's license if it fails program graduation and added state requirements within 18 months. It may revoke the license sooner when agreement violations or state or federal rule violations risk serious harm or death.
