More emergency medication access for patients

Beginning August 1, 2026, Louisiana lets licensed emergency medical technicians, advanced emergency medical technicians, and paramedics give patients time-critical prescription medicine they carry. Patients must have a rare disease, chronic illness, or special medical need, and they or their family must request treatment. Providers must follow their medical director's protocols. Medicine must be given through the nose, into a vein, or into a muscle. The Louisiana EMS Commission must approve practice standards that include this authority.

Patients face limits on medication lawsuits

Beginning August 1, 2026, Louisiana limits patients' legal remedies for outcomes from covered emergency medication treatment. Covered outcomes cannot lead to civil liability, criminal prosecution, or licensing discipline or other adverse licensing action against the provider. Coverage applies to patient-carried, time-critical prescription medicine for a rare disease, chronic illness, or special medical need. The patient or family must request treatment, and the licensed emergency provider must follow medical-director protocols. Treatment must use the nose, a vein, or a muscle. Protection does not apply when an outcome results from gross negligence or willful or wanton misconduct.
