Beginning August 1, 2026, covered Louisiana state and local agencies must seek commission advice before new construction in locally designated historic districts. This advice rule covers agencies responsible for property or public ways in the historic site, but excludes the governing body. It replaces the broader advice rule that also covered changes, renovations, and restorations. Agencies must also get a certificate of appropriateness from the commission before new construction in locally designated districts or at locally designated landmarks. State infrastructure projects are exempt from this approval requirement, and commissions can waive it. New construction means an entirely new building or structure permanently attached to the ground.
Beginning August 1, 2026, Louisiana historic district commissions can apply preservation rules to all property in their area, including public property. This covers buildings, structures, sites, and related property that help form the historic area's overall character. Commissions can also bring civil lawsuits to enforce these rules. They can ask courts to order violations to stop.
