Bill Overview

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Debit card users avoid extra charges

Beginning August 1, 2026, Louisiana businesses selling goods or services cannot charge extra for paying by debit card. This covers cards and payment devices that draw directly from a deposit account, including use by authorized users. Businesses owe cardholders actual damages caused by unlawful surcharges, but you must give written notice before suing. Private lawsuits are allowed only for willful or repeated violations, or violations not fixed within 30 days after notice arrives. If the business fixes the violation and repays the surcharge within those 30 days, that allegation cannot support a private lawsuit.

Consumers get surcharge reporting and enforcement

Beginning August 1, 2026, Louisiana's attorney general must establish and maintain toll-free phone and electronic reporting systems for unlawful debit surcharges. Complaints must include the business name and address, transaction date and amount, surcharge amount, and proof such as a receipt. The attorney general can sue businesses that break the rules, regardless of the limits on private lawsuits. If the court grants judgment or an order to stop violations, it must award reasonable attorney fees, court costs, and investigation costs. Breaking an administrative or court order carries a penalty of up to $500 per violation; collected fines and penalties support consumer protection and education.
