Lead checks before child-care and school openings

Covered Louisiana facilities first opening on or after August 1, 2026, need lead checks before operating, replacing the 2012 cutoff. Coverage includes licensed child-occupied daycare centers, preschools, elementary schools, proposed licensed early learning centers, and federally regulated daycare centers. It also includes public school prekindergarten and approved nonpublic school prekindergarten programs. Checks cover lead hazards in paint, dust, and soil on the site and grounds; results must accompany operating-license applications. Areas inspected, assessed, or treated for lead since 1978 are exempt, but unchecked portions still need assessment. Owners, operators, or governing authorities must keep records showing that prior work met applicable requirements. Sites with lead hazards cannot open until controls are completed and confirmed by the Louisiana Department of Environmental Quality. That department must notify the state health and education departments when hazards are found. A report showing no lead hazards, sent to all three departments, ends further testing requirements for opening. More testing may be required after major alterations or if hazards are later found. A certified risk assessor can approve a limited check for renovated buildings, but bare soil must be sampled. The environmental department must provide a list of approved or licensed testers, and the education department must give notice or publish information. Findings go to the state health officer and all three departments, with findings included in the annual Louisiana Health Report Card. The law also authorizes a state program to collect, analyze, and report lead-hazard and oversight data.
