Beginning August 1, 2026, Louisiana bail bond producers must submit a sworn statement before an insurer appoints them. The producer and all former insurers must sign it under oath. It must state that no premiums or unpaid judgments are owed to any insurer. The producer must also agree to clear all outstanding forfeitures and judgments on previously written bonds. The statement must use the insurance commissioner's form and go to the commissioner and former insurer. A former insurer is one that previously appointed the producer and remains responsible for outstanding bonds. If the producer misses payment obligations and the former insurer pays a forfeiture or judgment, that insurer must report it. Its sworn notice and supporting documents must reach the appointing insurer, producer, and commissioner within 30 days after receiving the statement. The appointing insurer must immediately cancel the appointment. Reappointment requires the former insurer to certify that all bond forfeitures and judgments have been cleared. The producer or appointing insurer can appeal to the commissioner within 10 days after receiving the notice and documents. The commissioner must issue implementation and enforcement rules, including procedures for appeals and pauses in enforcement.
