More coverage for brain injury care

New health plans issued for delivery in Louisiana must cover medically necessary acquired brain injury care beginning January 1, 2027. Older plans must comply at renewal, no later than January 1, 2028. The injury must occur after birth and cannot be progressive, hereditary, congenital, or degenerative. Covered care includes therapies for thinking, communication, behavior, and daily skills; brain and psychological testing; neurofeedback; and community reintegration services. It also includes inpatient, outpatient, day treatment, residential, home, and community-based care. Providers must meet licensing, accreditation, training, and experience requirements for brain injury rehabilitation. Plans cannot impose lifetime or unreasonable yearly limits on treatment days or sessions. Inpatient rehabilitation limits must be separate from post-acute rehabilitation limits, which insurers must state separately. Deductibles, copays, coinsurance, and out-of-pocket limits cannot be higher than for similar benefits. Plans cannot deny care solely because of its setting when that setting is clinically appropriate and meets applicable licensing or accreditation requirements. A clinical peer reviewer must review adverse decisions about brain injury services. Louisiana's insurance commissioner must establish a faster appeal process. The mandate excludes excepted-benefit and limited-benefit plans, short-term policies under 12 months, Medicare, Medicaid, and Louisiana Office of Group Benefits programs. Coverage applies only as federal law permits. Qualified health plans need not cover benefits beyond federal essential health benefits when those added benefits require state payments.
