Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

In-person bail posting remains available

Louisiana parishes that choose electronic bail bonds must allow both electronic and in-person posting. People who cannot or do not want to use electronic posting keep an in-person option.

Stricter rules for electronic bail agents

Electronic bonds require sheriff-approved software, and agents must apply for the sheriff’s approval in each participating parish. Applicants must live and have their main business in Louisiana and hold a Louisiana bail bond producer license for at least three years. Sheriffs can add local requirements, including local residence and digital boundaries that restrict where agents can post bonds. Providers must maintain and check approved-agent lists, block unlisted agents, and receive timely updates from sheriffs. For each posting, the approved agent must personally complete a live facial-recognition check and a second check independent of login credentials. Sharing logins, security devices, or authentication factors is banned, as is having someone else authenticate.

Bail fees and bank payment rules

Commercial bail bond insurers pay parish sheriffs $2 for every $100 of bond liability when submitting appearance bonds and powers of attorney. This is the only fee or tax on those premiums, subject to an existing statutory exception. Checks, cash, and automated clearing house (ACH) bank transfers are accepted; electronic-bond payments require ACH, which providers must offer. Licensed bond producers can charge defendants or people guaranteeing payment legally allowed electronic-bond fees, but only at the provider’s actual cost. These include platform, transaction, and ACH processing fees; dishonored payments can block further bond posting until outstanding fees are paid.
