New licensing safeguards for court-linked residential treatment

Beginning August 1, 2026, Louisiana sets new licensing rules for residential substance use disorder treatment. Facilities housing people referred by judicial agencies can treat anyone only with a Louisiana Department of Health behavioral health provider license that includes approval for residential substance use disorder treatment. Judicial agencies cannot refer people for this treatment until the department surveys the facility and grants that license. People can file complaints about unlicensed residential treatment with the department’s licensing section for investigation. Licensed doctors, mental health professionals, and behavioral health providers can still provide treatment, including substance use counseling, in a person’s residence.
