Retired judges keep pensions while serving

Louisiana’s Supreme Court can choose optional pay rules for retired judges assigned under statutory or constitutional authority. For contract or daily assignments, daily pay equals 1/20 of the assigned court judge’s monthly salary, plus reasonable, necessary expenses. Service is limited to 120 working or judicial days per fiscal year. The court can set lower pay; the day limit does not apply when claimed and payable compensation is at most three-fifths (60%) of the formula amount. Assignment pay comes on top of retirement pay, and the assignment cannot suspend or end the judge’s pension or retirement status.

Public employers fund judge retirement costs

Any costs of this law must be paid through additional employer retirement contributions. Funding must follow Louisiana’s constitutional retirement-funding requirements. The law does not lower employee contribution rates already set by law. No cost amount or additional contribution rate is specified.

Judges get retirement choices with deadlines

For covered judges and court officers, state-system membership starts on their first membership date in any public retirement system, plan, or fund. Retired judges assigned under either covered assignment law are exempt from specified retirement membership eligibility rules. Covered members can choose regular-member rules for service, retirement eligibility, benefits, and contributions. They must file that choice on retirement-system forms within 30 days of starting employment. The choice cannot be reversed.
