Garnishment warnings and fees for missed responses

Beginning August 1, 2026, Louisiana requires clearer warnings and added costs for missed garnishment responses. A garnishee is a person or business served because they may hold a debtor’s property or owe the debtor money. Sheriffs must serve the citation, petition, written questions, and a notice that property or money owed is being seized. The notice must warn in bold: failing to file sworn answers in court within 30 days risks owing the debtor’s entire debt. The warning itself does not create that liability. On a creditor’s motion, the court must enter judgment unless the garnishee proves they held no debtor property and owed nothing. Proving the actual property or amount owed limits the judgment to delivering that property or paying that amount. A garnishee who fails to appear after proper service has 30 days after service of the judgment to request a new trial. That request must include a sworn statement supporting the required proof. At the new trial, the garnishee must prove they never held debtor property or owed money during the proceeding, or fully satisfied the judgment up to the property or debt actually held at any time since service of the petition. Regardless of the motion’s outcome, the garnishee must pay court costs and reasonable lawyer fees for the motion. This includes extra costs and reasonable lawyer fees the creditor actually incurred because the garnishee was at fault for not responding initially.
