Local bans limited for sugarcane storage

Louisiana parishes and municipalities cannot enact or enforce bans on sugarcane bagasse storage that follows an approved best management practice plan. The Louisiana Department of Agriculture and Forestry must approve the plan in writing. The approved plan must also be provided to the Louisiana Department of Environmental Quality. Bagasse is material left after liquid is extracted from sugarcane. Covered forms include factory bagasse with only traces of cane liquid and farm bagasse with more cane liquid. They also include dewatered pulp recognized as fuel by the U.S. Environmental Protection Agency under 40 CFR 241.4. The law defines traditional farm practices as customary standards for similar farms under similar conditions, governed by established best management practices. The agriculture department and LSU AgCenter determine those practices for animal feeding operations, including confined operations.
