Clearer bank identity disclosures after mergers

After a merger or consolidation, a federally insured state or national bank can keep using the former state bank’s name. Once the former bank ceases to exist, that name can be used only as a division of the surviving or new bank. Signs, ads, and similar materials must clearly identify the facility as part of that insured bank without misleading customers. Legal and account papers must use the insured bank’s legal name, including deposit certificates, signature cards, loans, statements, checks, and drafts. Banks must train staff about deposit insurance confusion and ask new-account customers about deposits at the bank’s other locations. Soon after a merger or acquisition, staff must be reminded to point customers to the bank-identity disclosures. New-account depositors at the branch must sign an acknowledgment that its locations belong to one bank and deposits are not separately insured. The law took effect upon the governor’s signature.
