Beginning July 1, 2025, Mississippi agritourism operators must register annually with the state agriculture department and pay $50. Covered activities must take place at a registered location and let the public view or enjoy rural activities. The department must maintain a public list of operators, activities and locations, promote registered attractions, and issue guidelines. Registration does not make the department liable for the attractions. Registration fees go into a dedicated state fund that keeps unspent money and earns interest.
Beginning July 1, 2025, Mississippi agritourism operators must post the required warning clearly at the entrance, not at each activity site. Sign letters must be at least one inch high, and written service or rental contracts must include the warning in readable print. The warning explains natural activity risks, participants' possible negligence, and their acceptance of those risks. Operators lose this law's liability protection if they fail to meet the sign and contract requirements. Compliant operators can use the protection as a legal defense when injury or death results only from inherent risks. Those risks include hazards from land, water, plants, animals, structures and equipment, plus participant negligence. Protection does not cover intentional injury, willful or wanton disregard for safety, or failure to warn about dangers operators knew or should have known about. Product liability claims remain available, and other liability limits and the assumption-of-risk defense remain in place.
