Homeowners gain access to association records
Beginning January 1, 2027, homeowners’ associations established under RSA 292 must keep records and let members or their authorized agents inspect and copy them. Required records include accounting records; meeting minutes and actions outside meetings; member names, addresses, and voting rights; governing documents, maps, and rules; current leaders’ names and addresses; current contracts; architectural decisions; and the latest state annual report, if any. Associations must also keep financial statements and tax returns for three years, and ballots, proxies, and other voting records for one year after the related vote. Members must identify requested records at least 15 days ahead, with access during reasonable business hours at a mutually convenient time and place. Associations can withhold personnel, salary, and medical records; ongoing negotiations; specified legal and government proceedings; protected attorney communications and work; executive-session records; legally protected information; and other owners’ account records. Members can get photocopies or electronic copies where available, and reasonable copying fees cannot exceed the state public-records copying rate. Associations need not compile or combine information, and members cannot use disclosed information for commercial purposes.
Homeowners gain safeguards over association decisions
Beginning January 1, 2027, covered homeowners’ association boards and committees can hold closed sessions only within regular or special meetings. Closed discussions are limited to attorney consultations, existing or potential legal proceedings, labor or personnel matters, and qualifying contract negotiations. Contract talks, including bid reviews, qualify only when early disclosure would disadvantage the association or violate someone’s privacy; no final vote or action can occur in closed session. When an owner, board member, or their immediate family has a financial interest in a contracting company, the association must prominently disclose it in writing to all members before or with the meeting notice. The contract requires approval by a majority of member votes cast at a meeting with a quorum present, and the interested person cannot vote.
