4 provisions identified: 1 benefits, 0 costs, 3 mixed.
Tax and legal protections for pool members
If a pool meets the law’s standards, it is not regulated or taxed as an insurance company. Members are not liable for the acts of the pool or other members. Any surplus left after paying claims, reserves, admin, and excess insurance must be returned to members. Claims analysis and claims-management information is confidential.
Audits, actuarial checks, and rate notices
Each pool must get a yearly CPA audit and share it with members and the state. Each pool must also get a yearly actuarial review by a qualified actuary and file and share it. At least 10 days before setting annual rates, the pool must give notice, hold a meeting, explain any rate hikes, and discuss surplus returns. If a pool misses an audit or actuarial review, the state will obtain it and the pool must repay the cost.
Pooled coverage for child care and foster homes
Child care centers and foster family homes can form a pooled risk program once 10 or more agree in writing. Pools can offer liability and property coverage, including general and professional liability, workers’ comp, unemployment, fire, and theft. To get coverage, a provider must apply, meet underwriting rules, and pay premiums. The law takes effect 60 days after passage.
How pools are run and overseen
Each pool must be a New Hampshire legal entity with a written plan and filed bylaws. Each participant names a board member; the board is unpaid but may be reimbursed for reasonable expenses. Pools must make required informational filings and are overseen by the Secretary of State. Pools can sign contracts, own property, borrow, and pledge assets in the program’s name.
