Court remedies for kids harmed online

Covered minors injured by a violation can sue the covered online provider; a parent or the Attorney General can sue for them. For negligent or more serious violations, courts may award $5,000 per violation or three times the damages, whichever is greater. For reckless or knowing violations, courts may award extra damages as punishment. Courts may also order changes to stop violations, declare legal rights, and award attorney’s fees and litigation costs. These awards are not guaranteed payments.

New online privacy safeguards for kids

Covered online services must protect covered minors’ privacy and safety through safeguards set by the New Jersey Attorney General’s rules. The Department of Health can add criteria defining “compulsive use.” The Attorney General can investigate violations, bring civil cases, and make agreements to stop violations. Violating the law or its rules is an unlawful practice under the New Jersey Consumer Fraud Act. Violators face fines up to $10,000 for a first offense and $20,000 for each later offense.
