More training when referral salespersons switch

Beginning July 1, 2027, referral-company salespersons face added requirements when changing license status or returning after a lapse. Applicants with six years or less in referral sales need up to 36 training hours under commission rules. That rule applies only to applicants never previously licensed as a broker, broker-salesperson, or regular salesperson. Previously licensed applicants returning from referral sales to those roles need up to 45 hours under commission rules. After two or more consecutive years without a renewed or new license, referral-company salespersons seeking relicensing must pass the salesperson exam. They also need commission approval and the preceding term's applicable salesperson or referral-salesperson training, including cases approved after showing medical inability.

Training providers and instructors face penalties

Beginning July 1, 2027, the commission can investigate suspected real estate continuing education violations. It can place approved courses, providers, or instructors on probation, suspend approval, or revoke it. Instead, it can fine providers or instructors up to $5,000 for a first violation and $10,000 for later violations. These penalties do not automatically apply to individual licensees taking courses.

More renewal training for real estate licensees

For two-year license terms starting July 1, 2027, or later, most New Jersey real estate licensees need 18 training hours. Before each term, the Real Estate Commission decides whether to require two extra hours on timely topics. Salespersons need at least 10 core hours: Fair Housing (2), Ethics (3), Legal Updates (2), Agency (2), and Safety (1). Brokers and broker-salespersons need at least 14 core hours, adding Fiduciary Responsibility (2) and Broker Supervision (2). At least two listed topic hours, excluding safety, must be taken in person or through a live webinar. Brokers and broker-salespersons with at least 40 years of qualifying licensed experience are exempt. The commission determines which out-of-state experience qualifies.

Less renewal training for referral salespersons

Beginning July 1, 2027, referral-company salespersons need only two training hours for each two-year license renewal. The course must cover Referral Responsibilities and Legal Updates. These hours do not count toward regular training requirements for brokers, broker-salespersons, or other salespersons.

More out-of-state training can earn credit

Beginning July 1, 2027, New Jersey can award credit for more types of real estate courses taken in another state. Credit is no longer limited to courses meeting the former elective-course rule. The other state's real estate regulator must approve the course, and New Jersey's commission must approve its topic. The provider must submit satisfactory proof of attendance and completion.

Flexible training formats with credit rules

Beginning July 1, 2027, the commission can approve in-person, online, video, and live-webinar real estate training. Approval covers the provider, course content, and safeguards for secure, reliable delivery. Live webinars must include periodic progress checks, with satisfactory performance required for credit. Self-paced online or video courses require an exam score of at least 75% for credit. The commission cannot require a comprehensive exam covering an entire in-person course just to award attendance credit.

New training instructor and approval rules

Beginning July 1, 2027, training instructors must meet at least one of six academic, professional, legal, or teaching qualifications. Applicants relying on teaching experience must submit a resume describing it. Commission-licensed real estate instructors automatically qualify to teach the law's listed topics, not just core topics. The commission must decide committee-recommended course, provider, and instructor applications at its next regular meeting. If no meeting is scheduled within 30 days of receipt, commission staff must be assigned to approve or deny them.
