Public gets access to grid plans

The state utility board must make project applications, supporting work papers, and project scenarios available to the public. Each application must have at least 30 days for public comment. The board can protect confidential or proprietary information as allowed by law. The Division of Rate Counsel and PJM Independent Market Monitor can access confidential material after signing nondisclosure agreements.

Grid review fees can reach bills

Utilities must pay an application fee for covered grid projects using either expedited or standard state review. The state utility board sets the fee to cover its review costs. Utilities can recover this fee through customer rates under board rules. The law sets no fee amount.

State reviews utilities’ grid project plans

New Jersey utilities must get state approval for covered grid projects after PJM completes its local planning review. Covered projects include new lines at least 100 kilovolts and one mile long, and changes to existing lines at least 100 kilovolts. Approved regional projects and routine maintenance are excluded. Applications must include PJM’s full review record and explain advanced transmission technology use, costs, benefits, and applicable performance benchmarks. Utilities that omit meaningful use of these technologies must explain why and provide an independent cost comparison. Applicable out-of-state technology can count, including deployments by neighboring utilities under agreements. Utilities must identify the location and approval status; New Jersey approval does not replace required approvals elsewhere. The state board reviews the whole project and decides whether New Jersey customers can be charged for out-of-state components.
