Beginning January 20, 2027, producers selling firefighting protective gear with intentionally added PFAS chemicals must give buyers written notice. Notices must explain why PFAS is present and identify each chemical by its full and abbreviated names. Producers and buyers must keep notices for at least three years after purchase. They must provide notices and related sales records within 30 days of a request from New Jersey’s consumer affairs or fire safety division. Violating the notice requirements triggers remedies and penalties under the state Consumer Fraud Act. Beginning January 20, 2028, the law bans selling, offering, making, or distributing this gear for sale or use in New Jersey. Non-clothing protective equipment, including breathing, hearing, and protective communication devices, remains exempt from the ban until January 1, 2030. These rules cover intentionally added PFAS, including its breakdown products, but exclude technically unavoidable trace contamination. The responsible producer is the manufacturer that owns or licenses the brand; if none qualifies in New Jersey, responsibility shifts to the brand owner or exclusive licensee, then the first New Jersey seller. News media face no liability under this law for accepting or publishing ads for affected products.
