Gym members gain rights when clubs sell

These New Jersey protections cover health club contracts entered on or after June 30, 2026. Covered ownership changes transfer all or nearly all facility assets, or at least 51% of its ownership shares. Clubs must notify members by mail or electronically at least 60 days and again 30 days before the transfer. Notices explain the new business name, billing start date, and any service changes or rate increases. Clubs must also post transfer information from 30 days before through 26 days after the transfer, including members’ choices. If services decrease or rates rise, transferring your contract requires your consent within 30 days of the ownership transfer. Without consent, your contract is canceled. If services and rates stay the same, you can reject the contract transfer. You can also undo a contract transfer up to seven days before billing under the new owner starts. Qualifying charges during that seven-day period after your rejection or cancellation request must be refunded within 30 days of your refund request. A change in the business entity without an ownership change requires 30 days’ advance notice. These ownership-transfer rules do not apply to facility closures.
