Public gets data center resource reports
The Board of Public Utilities must post general data center water and energy report information online within 30 days of receipt. It must update that information as needed. Performance and sustainability details submitted under the state financial-incentive requirement remain confidential and exempt from public-record access. The Board can publish those confidential details only as anonymous, combined information from at least five facilities.
Data centers face new resource reporting rules
The law takes effect immediately. New Jersey data center owners and operators must report water and energy use every six months. Centers operating for at least one year on the effective date must first report within three months. Other centers must first report within six months. Reporting lasts three years from each center’s first report. The Board of Public Utilities then decides whether to make reporting permanent and adopts rules if it does. A narrow exemption covers licensed health care facilities used solely for internal operations, without commercial data processing or colocation for unaffiliated customers. Reports identify the facility, owner or operator, address, and starting month and year. They list total energy use in kilowatt-hours, the serving electric utility, and electric service agreements. On-site power details include main and backup supplies, permit numbers, capacity, tier level, fuel, and permitted emissions. Reports also measure annual computer equipment energy use at each connected uninterruptible power supply. Water reports give total and peak daily input in cubic meters across facility systems. They identify municipal, groundwater, or surface-water sources, whether water is potable or reclaimed, and each source’s share when sources are combined. The Board can require other needed information and must coordinate with the Department of Environmental Protection. Centers receiving state financial incentives must also report performance and sustainability measures; other centers can report these voluntarily. These measures divide reused waste heat, computer equipment energy use, renewable energy use, and water input by the applicable energy totals. Specifically, they report reused heat divided by total energy, total energy divided by computer equipment energy, renewable energy divided by total energy, and water input divided by computer equipment energy. Reused heat must replace energy needed outside the center. Additional measures include 12-month average computer intake-air and waste-heat temperatures, plus renewable electricity and reused heat in kilowatt-hours. After submitting a report, centers must give at least 60 days’ notice before substantial operating or technology changes requiring report updates.
