Fewer local restrictions for charger operators

Municipal and county review of chargers is limited to specific, identifiable public health or safety harms backed by substantial evidence. Other legal requirements still apply; general planning concerns cannot block approval unless required by state law or regulation. Charging equipment can extend into local setback areas, with at least six feet between equipment and obstructions where needed for landscaping, mowing, or upkeep. Equipment cannot block required sight areas, fire lanes, or emergency access. Municipalities cannot treat corporate logos, branding, or symbols built into chargers as signs under local sign rules.

Simpler charger permits with application requirements

New Jersey’s law takes effect immediately and covers applications pending or submitted on or after enactment. Qualifying chargers and parking spaces prepared for chargers at existing gas stations, stores, and other buildings get administrative permits without land-use board review or variances. Installations must meet property size and placement rules, prior approval conditions, construction codes, and safety standards, with the setback exception; inspections remain required. Applicants must pay a permit fee, with no amount specified, and submit a site plan or scale drawing showing existing and proposed features on the property and within 50 feet of the charger. Applications with the fee and required documents are deemed complete unless officials issue an incompleteness notice or one-time written correction notice within 20 days.
