Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Lease money must improve local parks

All lease proceeds must go only to park and recreation capital projects or to buy more park and recreation land or facilities. The town must also set aside at least the fair market value of the easement interest for these projects.

Safeguards and federal checks on parkland

If wireless use stops or the lease ends, the land and easement return to the town for park use. The tower must be removed and the site restored to park‑ready condition. Also, if the parkland got federal funds, the town cannot alienate it unless it meets federal rules, including showing the Secretary of the Interior that replacement land is equal in fair market value and usefulness.

Brookhaven can lease parkland for cell tower

The law lets Brookhaven stop using a 0.057‑acre park parcel in South Setauket and lease it to Tag Towers LLC for a wireless tower. The lease can last up to 30 years, must be at fair market value, and follows terms set by the town board. The town may also grant a 0.552‑acre easement over parkland so the company can access the site and install, run, and maintain an underground power cable. Tag Towers must restore the ground after installation, and the easement area stays for park use.
