Bill Overview

Analyzed Economic Effects

6 provisions identified: 2 benefits, 0 costs, 4 mixed.

Privacy rules and image deletion

Photos and videos are for the city’s use to handle the ticket only. The city must destroy images when the case is fully resolved or one year after the notice, whichever is later. The images are not public. Owners and drivers can inspect or copy them while they are kept. Only narrow criminal warrants or subpoenas can access them.

Camera testing, warning signs, and purchasing

Each camera must pass a self-test every day it is used. An independent lab must calibrate each system yearly, and the city must keep the signed certificate. The city must post advance warning signs and choose sites using speed data, crash history, and roadway features. Operators must be trained and keep daily setup logs. The city must follow state competitive bidding rules when buying or leasing camera equipment.

How to fight or shift a ticket

You can avoid liability by mailing a certified police report showing the car or plates were reported stolen before the alleged speeding. You can defend a case by showing the camera system was malfunctioning at that time. The driver is presumed to have the owner’s consent, but owners can prove lack of consent and are then not liable. Owners who were not driving can sue the driver to recover fines. If you lease out cars and have filed the required info, you have 37 days after a notice to name the lessee so the city can bill them instead.

Notices, hearings, and photo evidence rules

The city must mail a notice within 14 business days to in-state owners, and within 45 business days to out-of-state owners. Each notice must include two time-stamped rear images, the place, date and time, vehicle info, camera ID, and how to contest. The Poughkeepsie parking violations bureau handles hearings. A technician’s sworn certificate counts as initial evidence, but you can inspect the images before and at the hearing.

School zone camera tickets and costs

You can be fined if your car is recorded going more than 10 mph over the posted limit in a covered school zone during allowed times. The fine is capped at $50 per ticket. If you do not respond, the city may add up to $25 more per ticket. This is a civil penalty only. It is not a criminal conviction, is not put on a driving record, and insurers may not use it.

Poughkeepsie school speed camera pilot

The law lets the City of Poughkeepsie run speed cameras in up to three school zones at a time. A school speed zone covers up to 1,320 feet next to a school. Cameras work on school days during school hours and one hour before and after. They also work during student activities and 30 minutes before and after those events. The law takes effect 30 days after it became law and ends December 31, 2030, unless extended. Agencies can set needed rules right away.
