How to contest or shift camera tickets

You have a defense if your car was reported stolen before the violation and not yet recovered; mail a certified police report. You can also claim the signal was malfunctioning at that time. Owners are not fined if the driver used the car without consent, but the law presumes consent unless you prove otherwise. Owners who were not driving can sue the driver to get the money back. Rental and leasing companies avoid liability by giving the lessee’s name and address within 37 days; for parking bureau cases, they must also have a prior section 239 filing. If they do not, they pay.

Red-light camera tickets in Poughkeepsie

Poughkeepsie can use red‑light cameras at up to nine intersections. If your vehicle runs a red light with your permission, the owner owes a civil fine. Each ticket is capped at $50. If local law allows it and you do not respond, up to $25 more can be added. Notices come by first‑class mail and list the date, time, place, plate, camera ID, and how to contest. A city technician’s sworn certificate and the camera images count as initial proof. Cases are handled by the traffic violations bureau or the court; the city may use an administrative or parking bureau. This is not a criminal conviction, does not go on a driving record, and insurers cannot use it. The program aims to avoid showing drivers, passengers, or what is inside the vehicle. If the city made reasonable efforts, a ticket does not get tossed just for showing contents. Owners are not liable under this program if the driver is convicted of the moving violation.

Pilot timeline, bidding, and records rules

The law takes effect 30 days after it becomes law. Local Poughkeepsie camera laws stay in force only until December 1, 2030. The statewide authorization ends December 1, 2031. The city must buy or lease equipment using competitive bidding rules. Photos and videos from the program are handled under a special public‑records rule that limits what can be released.
