The law makes it illegal to pretend to be an employee organization or its representative. It applies when someone intends to trick the recipient and cause harm using spoken, written, or electronic messages that falsely claim approval. The Attorney General can sue, get quick court orders to stop it, issue subpoenas, and go after senders outside New York who send messages into the state. Courts can fine violators $1,000 for each incident and may lower the total if it is out of proportion. Only the employee organization can choose who is an official representative, using its own rules. The law takes effect immediately.
