6 provisions identified: 3 benefits, 0 costs, 3 mixed.
Each camera must pass a self‑test every day it operates and be calibrated yearly by an independent lab. Trained operators must sign a daily setup log. Pelham must post clear warning signs on advance warning and/or speed limit signs in each school zone. Signs and placement must follow the Manual on Uniform Traffic Control Devices.
Pelham must send a report by June 1 each year. It must list camera locations and dates, crash and injury data, violations by zone and speed, tickets issued, fines paid, results of cases, revenue, and costs. The report also reviews how ticket hearings work.
State officials may issue needed rules right away so the program is ready on the effective date. Pelham must buy or lease camera equipment using competitive bidding rules. These steps set up and run the program.
Owner liability applies when a camera records a vehicle over 10 mph above the posted school speed limit. The civil fine is up to $50 per violation, plus up to $25 if you fail to respond. Notices must be mailed within 14 business days in‑state or 45 business days to non‑residents and must include two dated rear photos. Cases go to the traffic violations bureau or local court; a stolen vehicle or plate is a defense. A rental company can shift liability by naming the renter within 37 days. These tickets are not a conviction, do not go on a driving record, and cannot be used by insurers.
The village must avoid capturing faces or vehicle contents when practicable. Images are used only to issue and decide tickets. The village must destroy images after the case is final or after one year, whichever is later. Owners can inspect their images, and courts can require images with a proper warrant or subpoena. The law treats these images as public records under state law, with limited public access.
Pelham may run up to seven school speed cameras at once. Cameras enforce only in school speed zones. They can run on school days during school hours, plus one hour before and after. They can also run during student activities and 30 minutes before and after. The law takes effect 30 days after enactment and ends December 31, 2031.
