Attorney-certified documents allowed for foreign adoptions

When you finalize or ask a court to recognize a foreign adoption, you can file attorney-certified copies of key records. These include the foreign birth certificate (or similar proof of birth) and the foreign adoption decree. Attorney-certified translations of those records are accepted.

New York birth certificates for foreign adoptees

New York must issue a state birth certificate after a foreign adoption is finalized or recognized. This applies only if no New York birth record exists and no birth data certificate exists for the person. You must submit the foreign adoption papers and certified translations. You must also include proof of the adoptee’s birth date and place; proof the adoptive parent lived in New York at the time or that the adoption was lawfully done in New York; and evidence of IR-3, IR-4, or IH-3 visa status (or a successor). The record lists the adoptee’s name, sex, date and time of birth, place of birth, mother’s maiden name, and father’s name. It also covers foreign-born adults adopted in New York, and people adopted earlier can apply under the same rules.
