Hospitals in cities or counties with 1,000,000 or more people must keep at least one off-duty police officer or trained security in the emergency department at all times. In smaller areas, hospitals must have at least one on the premises at all times, with priority near the ER and direct responsibility to it. Critical access, sole community, and rural emergency hospitals are exempt, but if violence against ER staff rises, the state health commissioner works with them to meet the rule over time. The rule allows short staffing changes during emergent circumstances.
The law takes effect 280 days after enactment, and within 12 months every general hospital and nursing home sets up a workplace violence prevention program. Hospitals must involve employees and any unions, share a written plan summary, and tell staff how to report incidents. Beginning January 1, 2027, general hospitals do a yearly safety and security assessment and update a written plan that fits their size and risks. Plans use steps like staff training, security, alarms, and facility changes. Hospital programs align with federal hospital rules and similar accreditor standards; nursing homes can meet the rule by following certain federal nursing home rules if their plans address violence.
