Certified doctors and programs can give methadone and other approved medicines to people with substance use disorder, following all laws. Doctors with federal approval can give buprenorphine without a separate state operating certificate. Programs seeking a state certificate must have detox steps to help patients taper off maintenance drugs. The law allows controlled drugs in cases like emergencies, terminal illness, dangerous withdrawal, short-term help while on a waitlist, and approved programs. Counties and cities may run detox centers, clinics, halfway houses, and referral programs.
Except as allowed elsewhere in state law, doctors cannot prescribe, give, or dispense Schedules II–V drugs to people legally defined as having a substance use disorder or to habitual users. The law defines a “person with substance use disorder” as someone who habitually and unlawfully uses a controlled drug and is dependent on it. If a doctor or consultant treats such a patient, they must report the person’s name and, if possible, address to the health commissioner. These reports are confidential and used only for statistics, epidemiology, or research.
If you are in a habeas corpus or civil commitment case and cannot afford a lawyer, the court can appoint one to represent you. Appeals courts can also assign counsel on appeal. The court may appoint up to two psychiatrists, psychologists, or physicians to examine and testify. They are paid, usually capped at $3,000 per case, unless there are extraordinary circumstances.
