The law takes effect one year after it becomes law. The transportation department can adopt and finish needed rules before that date. The department posts program information and highway safety tips on its public website.

Families can apply for roadside memorial signs

The law creates a state program for roadside memorial signs on state‑maintained highways. An immediate family member must apply within five years of the fatal crash and pay a fee set by the transportation commissioner. The crash must be on a state highway and reportable to the federal Fatality Analysis Reporting System. Any immediate family member can object; if anyone objects, the sign is not placed or is removed. No sign is allowed if the person who died was driving while intoxicated or impaired and, because of that, caused serious injury or death to another person.

Rules for memorial sign placement and use

The transportation commissioner decides where signs go based on the crash location, road design, other signs, right of way, and safety. Signs must follow the Manual on Uniform Traffic Control Devices and other laws, and cannot be placed in front of a home or business. Only one sign may be at a location; if several families apply, the department can use a design that lists multiple names. Memorial signs are removed two years after first placement. If a sign is damaged, a family member can apply and pay to replace it for the rest of the two years; if the department caused the damage through negligence, it replaces the sign for free. On‑site dedication ceremonies and decorations at the sign are not allowed.
