Authorizes the discontinuance of certain parklands in the town of Amherst, county of Erie

Amherst allows tower lease with park protections

Effective immediately, Amherst's governing body can remove park status from a specified 0.892-acre parcel and set lease terms. The town can lease it to Verizon Wireless for a communications tower at fair market value for up to 30 years. Lease money must fund new parkland, major improvements to existing parks and recreation facilities, or both. If federal money helped buy, maintain, or improve the land, the town must meet federal requirements before changing its use. This includes securing Interior Secretary approval that replacement land has equal fair market value and usefulness. When tower use stops, the lease ends and the land returns to Amherst for public parks and recreation. The tower must be removed, and the land restored to its prior state consistent with those uses.
