Show housing bias by unequal results

The law lets you prove housing discrimination by showing a policy’s unequal effects, even without proof of intent. A discriminatory effect includes rules that cause unequal results or keep housing patterns segregated. It covers race, creed, color, national origin, citizenship or immigration status, sexual orientation, gender identity or expression, military status, sex, age, disability, marital status, status as a victim of domestic violence, lawful source of income, and familial status. First you must show the unequal effect; then the provider must justify the rule; you can still win by showing a less‑discriminatory option works.

Starts now; other rights remain

The law takes effect immediately. It applies to housing actions and cases from now on. Agencies can add or change rules to carry it out right away. It does not limit broader ways to prove discrimination that already exist under state law.

When housing providers can justify policies

Housing providers can defend a practice by proving it is needed for a substantial, legitimate, non‑discriminatory goal, with real evidence. They must also show no other practice would meet that goal with less unequal impact. This defense does not apply to claims of intentional discrimination.
