Certified peer advocates can enter prisons and jails

Prisons and jails cannot say no to a certified peer support advocate only because that person was once incarcerated. This applies when the advocate is helping with substance use treatment and reentry services inside the facility, including medication-assisted treatment allowed under state law. The advocate must be certified or licensed by a state agency, a state‑authorized group (like the New York Certification Board), or a national accreditor. Facilities can still limit entry for safety or other allowed reasons.

Law takes effect in 60 days

The law takes effect 60 days after enactment. State agencies can update rules right away to carry out the law. They may add, change, or repeal rules as needed and finish those updates by the effective date. This helps facilities and providers be ready when the law starts.
