Benefits protected when your job changes

If you already met the 4‑week or 26‑week test and return after an agreed unpaid leave, you are eligible right away. If you were getting unemployment or temporary disability benefits, you get disability coverage right away when you start with a covered employer. You keep disability eligibility for 4 weeks after your job ends, and you are covered immediately if you take a new covered job in that window. Your job is not treated as ended while you are eligible to receive these benefits for that job.

Workers get faster access to disability and family leave

The law makes you eligible for disability after 4 straight weeks with a covered employer. You can get paid family leave after 26 straight weeks with a covered employer. If your trade hires day-to-day, you qualify if you worked during the usual work period. If you work a reduced schedule, you get disability on day 25 and family leave on day 175.

Union construction workers get easier family leave

If you do construction or related work under a union agreement and worked at least 26 of the last 39 weeks for signatory covered employers, you can get paid family leave. If you return after an agreed unpaid leave, you are eligible right away, even if you return to a different employer. If you were laid off and got unemployment, you qualify upon return if you meet the 26‑of‑39 weeks test. You keep this eligibility only while you are working for a covered employer.
