New York bans horseshoe crab harvesting

Beginning January 1, 2026, taking horseshoe crabs from New York waters is prohibited, including for commercial or biomedical use. The state Commissioner may allow genuine scientific or educational taking under regulations, including at public or nonprofit zoos and aquariums. The law replaces local harvest-closure consultation requirements with the statewide ban and these limited exceptions.

New York extends crab fishing rules

The law extends New York's crab-management authority through December 31, 2027. Beginning January 1, 2026, this authority excludes horseshoe crabs, and commercial crab taking requires a state permit. Taking or landing more than 50 crabs in one day creates a presumption of commercial activity. Selling, bartering, or offering any self-caught crabs for sale also creates that presumption. Permits go to individuals; a vessel endorsement covers everyone aboard. The department can regulate size, catch, possession, seasons, closed areas, harvesting, landing, gear, fishing effort, permits, records, transport, and sales. This includes moon-based closures and bans on harvesting mating crabs. Rules must be at least as strict as state law and follow applicable Atlantic States Marine Fisheries Commission and federal fishery plans.
