Contractors get a 5% payment holdback cap
In New York construction contracts, retainage—money held back from payment—cannot exceed 5% of the total contract amount. This cap applies to retainage governed by General Business Law Section 756-c. Contract terms and related agreements requiring more than 5% are void. The law took effect immediately upon enactment.
