Fines for illegal pay-to-quit notes

Employers who break this law pay $1,000 to $5,000 per worker. Each person forced to sign or each person the employer tries to sue counts as a separate violation. The commissioner sets the fine. Total fines can add up fast across many workers.

Workers protected from pay-to-quit notes

Employers cannot require “pay-to-quit” promissory notes as a job condition. Any clause that makes you pay for leaving early, including “training repayment,” is void. The rule covers employees, contractors, interns, volunteers, apprentices, and sole proprietors who provide services, even through a business or nonprofit, and it applies to companies, governments, subsidiaries, and training groups. Voiding the note does not cancel the rest of your contract. Some deals still stand: repayment of non‑training cash advances, payment for property you buy or lease, sabbatical terms for school staff, and union‑agreed programs.

Workers can recover lawyer fees

If your employer sues to enforce a promissory note this law voids, and you win, you can recover your attorney’s fees. This only applies to suits to enforce those void notes.
