Beginning one year after enactment, kratom products sold in New York cannot say or imply they are "all natural." Manufacturers, packagers, and advertisers must remove that claim from labels and ads. The goal is to prevent misleading messages about what is in these products.
Beginning January 1, 2026, every kratom package sold or delivered by a manufacturer in New York must carry a warning. The warning must be at least 12-point type and in a color that contrasts with the package. It must state: "WARNING This product has not been approved by the FDA. Side effects may include nausea, agitation, hallucinations, difficulty breathing, liver damage, and death." This helps buyers see safety risks and the lack of FDA approval before they use the product.
Manufacturers that violate New York’s kratom labeling or ad rules face civil penalties. A first violation can be fined up to $500. Each second or later violation can be fined up to $1,000. Penalties apply each time a manufacturer is found in violation.
