The law caps civil fines by license type. It sets $10,000 maximums for certain retail permits and for a section 53 wholesaler during beer-at-retail home sales, $30,000 for licenses under sections 30, 31, 53, 61-a, 61-b, 61-c, 76, 76-a, and 78, and $100,000 for licenses under sections 51, 61, and 62. These fines are on top of any required bond. If no appeal is pending and you do not pay after a written demand sent by first-class mail, the process starts. Once the penalty is unpaid for more than 45 days, the State Liquor Authority must send a default-judgment notice to the premises and the signer’s last known home address. The notice gives 20 days to pay. If full payment is not received within 30 days of mailing the notice, the state can file a default judgment that lasts eight years.
The law creates a brand owner’s license. If you hold a federal basic permit, you can apply to the State Liquor Authority. The license lets you contract with a licensed New York manufacturer to make your products. You may appoint a licensed in‑state wholesaler as your exclusive brand agent to solicit, negotiate, and receive payments for sales to retail licensees for on‑ or off‑premises consumption. You can also sell to that wholesaler and receive payment. Any manufacturer you contract with must act within its own license limits. You must pay $103 each year for the brand owner’s license. The Authority will set rules for how the license works.
