The law lets Monroe County offer Christopher R. Fay, a captain hired on August 26, 1991, the optional 20-year retirement plan. The county must file a resolution with the State Comptroller within 180 days and certify he did not miss the signup due to his own negligence. After the county files, Fay must elect coverage with the Retirement System within one year of the law’s effective date. Once both steps are met, his service from August 26, 1991 to now is credited under the 20-year plan. The act takes effect immediately, so these deadlines run from the date it became law.
Monroe County must pay all employer past service costs tied to this change. The county can spread these costs over five years. A fiscal note estimates about $153,000 in one-time past service cost (or about $34,200 per year for five years with interest), plus about $14,000 more in annual contributions for the year ending March 31, 2026.
