Fishkill can add hotel stay tax

The town of Fishkill (outside the village) and the village of Fishkill can adopt a local hotel or motel tax. The rate cannot be more than 2.5% of the room’s daily rate. “Hotel” includes hotels, apartment hotels, motels, and boarding houses. The tax does not apply to New York State, the U.S. when immune, or qualifying nonprofits. Money goes to the town or village general fund. Each local tax can last up to three years, and the state authorization ends December 31, 2027.

Hotel owners must collect occupancy tax

If a local tax is enacted, the town or village finance officer runs collection and enforcement. Hotel and motel owners may be required to collect and pay the tax and can bill it to guests like part of the rent. Returns and payments can be monthly or on another schedule set by local law. Owners can challenge a final tax bill or a refund denial in court within 30 days, with a deposit or approved undertaking. The government generally has three years after a return is filed to assess more tax, unless there is fraud or no return.
