The law bans discrimination in home appraisals. Appraisers cannot base value or deny service because of race, creed, color, national origin, citizenship or immigration status, sexual orientation, gender identity or expression, military status, sex, age, disability, marital or familial status, being a victim of domestic violence, or lawful source of income. The rule covers appraisals for owners or occupants and nearby properties. It also covers anyone who holds themself out as doing residential appraisals, licensed or not, and includes written and oral comments used to support value.
The state keeps a dedicated anti-discrimination housing fund. It gets money from appropriations, transfers, gifts, and half of certain fines. The Attorney General uses it for fair housing testing, outreach, investigations, and to address biased appraisals, including new appraisals or review work. Local human rights offices and eligible nonprofits can apply for grants.
The Department can suspend or revoke an appraiser’s certification or license. It can also fine up to $2,000, instead of or along with discipline. The Department must give at least 20 days’ written notice of charges before a hearing. Appraisers and licensed assistants can appear in person or with a lawyer. If violations are found, the Department issues written findings and a final order. Half of these fines go to the anti-discrimination housing fund.
