Guaranteed pay for construction workers

Construction employees who report as scheduled get paid for at least four hours, or the scheduled shift if shorter, at their promised hourly wage. If a scheduled shift is canceled with less than 12 hours’ notice, the employee gets two hours of pay at the promised wage. These payments count as wages under the labor law. The rules take effect 90 days after enactment.

Guaranteed pay on public construction jobs

On covered public construction jobs, workers who report for work get at least four hours of pay at the prevailing wage, including supplements. If the posted prevailing rate already promises more reporting pay or benefits, the higher amount applies and no extra is due. If a scheduled shift is canceled with less than 12 hours’ notice, the worker gets two hours of pay at the prevailing wage. These payments count as prevailing wages and supplements. The rules take effect 90 days after enactment.
