In counties outside New York City, a defendant can ask to move a case to a neighboring county’s specialty court. The court must be a designated human trafficking, veterans treatment, or mental health court. Both district attorneys—the one where the case is and the one in the neighboring county—must agree. A transfer order takes effect after five days unless the receiving court declines or agrees to take it sooner. When the receiving court accepts or declines, it must promptly tell the defendant, the defense lawyer, and both district attorneys. Once transferred, the designated court handles the case through final judgment.
A case with a family offense charge cannot be moved to a veterans treatment court when the accused and alleged victim are in the same family or household. This closes that transfer option for those domestic cases.
