Practice privilege rules for out-of-state CPAs

If you are licensed in another state and in good standing, you may practice in New York under a privilege. Your main place of business stays in that other state, you complete one of New York’s education and experience paths, and you pass the written exam. For some listed services, you must work through a New York‑registered firm; for other listed services, you may use a firm licensed in another state even if it is not New York‑registered. If your license is not in good standing, or you have certain final discipline or recent disciplinary or criminal issues, you must notify the department on its form and get written permission before practicing. Practicing under the privilege means you and your firm accept New York’s discipline and legal service rules. If you file a New York license application, you can keep practicing under the privilege while it is pending, even after New York becomes your main place of business.

Two paths and exam for NY CPAs

The law sets two education options: at least 120 or at least 150 semester hours in a state‑approved accountancy program. In both cases, you must meet subject hour rules set by the commissioner. If you use the 120‑hour path, you need two years of acceptable full‑time experience; the 150‑hour path needs one year. You must pass a Board‑approved written exam; this rule cannot be waived. You do not need more than 120 hours of education to sit for the exam.
